The rules for using the Kuriosa app and this website, in plain words.

Who we are

Kuriosa, the app and the website kuriosa.app, is published by:

In these terms, “we” and “us” mean the publisher. You reach us at support@kuriosa.app.

What these terms cover

These terms apply to the Kuriosa app for iPhone, with its free and its paid features, and to this website, with its help center, the published formats, and the tool Open a backup without Kuriosa. By using Kuriosa or this website, you accept them. What happens with data is explained in the privacy policy.

You get the app from Apple's App Store, under Apple's standard licence agreement (the “Licensed Application End User License Agreement”). These terms add to it. If the two ever contradict each other, Apple's licence agreement prevails.

Your right to use Kuriosa

You may use Kuriosa on the Apple devices you own or control, for your own collection, as Apple's licence agreement allows. You may not sell, rent out, or pass on the app itself.

Your data is yours. Its formats are published, so you can read your data with other programs, also without Kuriosa.

Your data, your backups, and your recovery key

Kuriosa stores your collection encrypted on your iPhone, or in a folder you choose. We have no server and no copy of your data, so we cannot restore it for you.

You are responsible for:

Without your recovery key and without a device that opens your collection, nobody can open your data or your backups, not even us. A lost recovery key cannot be replaced.

Values, prices, exchange rates, and reminders

What Kuriosa shows or calculates is an aid for your own overview, not a guarantee: values and prices, totals, calculation fields, prices per unit, counts, converted totals, and reminders. In particular:

No advice

Kuriosa is a tool to catalogue your collection. It gives no legal, tax, insurance, investment, or valuation advice. Whether an insurer, an authority, or a buyer accepts a list or a value from Kuriosa is up to them. When you need advice, ask a professional.

What you catalogue

You decide what you enter in Kuriosa, and you are responsible for it. Kuriosa does not check your entries.

You are responsible for following the laws that apply to your pieces and to what you do with them, for example to owning, registering, storing, transporting, selling, importing, or exporting them. This applies in particular to weapons, firearms, ammunition, knives, alcohol, protected species, and cultural property.

If you record other people's details, for example the name of a buyer or of someone you lend a piece to, you are responsible for doing so lawfully. Add only photos and documents that you are allowed to use.

Links, shared files, and other services

Links you store open in Safari. If you turn on Link previews, Kuriosa loads the linked page to show its title and picture. We are not responsible for other sites, for the shops behind them, or for what you buy there.

Files you share leave Kuriosa: PDF, Excel, and CSV files are not encrypted. Whom you send them to, and where you keep them, is up to you. Keep the password of an Export everything … file safe; without it, the file cannot be opened.

Purchases

Kuriosa is free with a limit; Kuriosa Unlimited and Kuriosa Pro are one-time purchases. You buy them from Apple, in the App Store. Apple's terms of sale apply, including its rules for refunds: we cannot take or refund payments ourselves. A purchase is linked to your Apple Account and can be restored in the app.

These terms are an agreement between you and us. Apple is not a party to them and is not responsible for Kuriosa, its support, or claims about it.

We develop Kuriosa further and may change its features in updates, to the extent permitted by law.

No warranty

We make Kuriosa with care, but no software is free of errors. To the extent permitted by law, Kuriosa and this website are provided as they are, without any promise that they are free of errors, always available, work with every device and every version of iOS, or suit a particular purpose. The tool on this website and the published formats are free and come without any warranty.

Where the law of your country gives you warranty rights that cannot be excluded, you keep them.

Liability

To the extent permitted by law, we are not liable for:

Where we are nevertheless liable for slight negligence, our liability is limited to the amount you paid for Kuriosa, to the extent permitted by law.

These limits do not apply where the law does not allow them: in particular, not to our liability for intent and gross negligence, for injury to life, body, or health, under product liability law, and under the mandatory consumer protection law of the country where you live.

Claims of others

If someone makes a claim against us because of what you entered or shared, or because you broke the law while using Kuriosa, and you are to blame for it, you compensate us for the resulting damage, including reasonable legal costs, to the extent permitted by law.

Rights to Kuriosa

The app and this website, their design, texts, pictures, and templates, and the name Kuriosa belong to us or to those who licensed them to us. The downloads on the formats page may be used, copied, and changed, as stated there. Your content belongs to you; we do not receive it and claim no rights to it.

Changes to these terms

We may update these terms, for example when Kuriosa gets new features or the law changes. The new version is published on this page with its date and applies from then on. If you do not agree with it, you can stop using Kuriosa.

Law and courts

These terms are governed by Swiss law, without its rules on the conflict of laws and without the United Nations Convention on Contracts for the International Sale of Goods. The courts at the publisher's place of business have jurisdiction: [place: added with the publisher's address].

If you use Kuriosa as a consumer, you keep the protection of the mandatory law of the country where you habitually live, and you can also go to the courts there where that law allows it.

Final provisions

If a part of these terms is invalid, the rest stays valid, and the rule of law that comes closest to the purpose of the invalid part applies instead. These terms are published in English, German, French, Italian, and Spanish; if the versions differ, the English version prevails, to the extent permitted by law.
